If you are going through a divorce then the chances are you will retain the services of a divorce attorney to help you through some or all of the process. Getting the right attorney here can mean the difference between a simple and quick divorce and one which is complicated, drawn out and possibly even acrimonious.
For some people the attorney they retain here will work with them throughout the entire divorce process and they will be involved every step of the way. So, your attorney here could help you negotiate your divorce settlement, mediate with your attorney’s spouse on your behalf and handle all the legal processes that are involved. In other cases you may only use the attorney to make sure that the legal processes are sorted quickly and effectively.
In either case, choosing the right attorney here is vital. You need to have a legal professional on your side who is ready, willing and able to fight your corner, protect your interests and see that everything is tied up correctly from a legal perspective. This is essential even if you and your spouse are planning an amicable divorce.
The first thing to consider here is the experience of the attorney that you hire. You should be looking to retain an attorney with specific experience of handling divorce cases. So, look for an attorney who is experienced in/qualified for family law cases.
This may mean looking for a specialist who is ‘board-certified’ in family law in certain regions. The extent that you need to use an attorney to organize your divorce may also play a part. If, for example, it is likely that your divorce will involve lengthy court sessions then opting for a court-experienced attorney will make most sense.
It is also important to find an attorney that you feel that you can work with. They do not need to become a friend but it helps if you feel comfortable with them and trust their advice. If this is the first time that you are going through a divorce then look for an attorney who can explain the process to you clearly and simply.
Remember, any attorney that you hire here should work to promote your own best interests. But, if you have children and their care and wellbeing is central to your divorce then look for a lawyer who takes this into consideration as well. An unscrupulous lawyer who only looks at the bottom line does not have the best interests of your family at heart.
Cost is also a big issue here. Divorces can be costly enough without spending vast sums of money on your representation. But, do try not to cut corners and save cash by choosing the cheapest attorney that you can find. This could simply see you lose money in the long run even though it may seem the cheaper option in the beginning.
One of the biggest problems that we come across when choosing an attorney to help us with a divorce is the fact that we’ve never done this before so we don’t already know a good attorney. One good (and quick) way of finding a good attorney is to talk to people who have used one before and to ask them what they thought of the service they were given.
