The Consumer Protection Act, 1986 sought to bring consumer rights to fore and to voice concerns of an aggrieved consumer under any discrimination. Consumer Forum Kolkata gives consumer the right to complain against any violation on consumer rights and avail a speedy redressal. The aggrieved consumer can also ask for a rightful compensation against any loss or injury that comes out of negligence or any act of deficiency on part of the manufacturer or the service provider. The Act makes a provision for the consumer to make complaint at the district, state or national commission.
The consumer forum Kolkata is one of the 604 district forums that make for a conspicuous presence at each of the districts in Indian state. In order to keep things simple for a consumer the proceedings at the consumer forum are kept concise in nature. The endeavour with the existing litigation on consumer rights is to avail justice in the quickest possible time frame. The Act makes a special mention of a stipulated time schedule for a timely disposal of consumer grievances. This is pretty much unlike to the existing state of litigation affairs in our country which is known for being lethargic, costly and time consuming. The consumer forum also makes a provision for the consumers to challenge the existing judgment at a higher court under any state of dissatisfaction. For instance, the consumer can make an appeal at the national commission against any order or judgment of the state commission’s order.
The aggrieved consumer is required to first file-in a written complaint on the incidence at the district consumer forum. The written complaint should also be sufficed with all the relevant documents and the evidential support to substantiate the claim. On the date of actual hearing the court will listen to the concerns of both the parties i.e. the defendant and the complainant. The order will be issued after 15 days of hearing.
What makes the establishment significant is the fact that the aggrieved consumers are able to first raise their voice against any violation of consumer rights and be also compensated for his loss. The consumer forums make this happen within a stipulated time schedule and at a much lesser cost. Kolkata has evolved as a progressive city in the last few years and the credit goes to the employment opportunities and economic development. Unfortunately the development is also accompanied with many an instances where the consumers are cheated, misinformed and misrepresented. The Consumer Protection Act 1986 sees to it that the injustice is reported at an appropriate platform and the aggrieved is compensated for his loss and sufferings. For the residents of Kolkata, the consumer forum comes as a remedial measure to answer the inadequacies in the trade laws. The objective is to keep the buyer-seller relationship most intact and prevent the consumer from being deprived of his rights as a consumer. This and an early settlement of the consumer grievances should make sure that the consumer remains protected.
